Staff outlines Board options after planning commission denial and explains vote thresholds

Planning staff explained the board's options after the planning commission's recommendation of denial and described vote thresholds tied to a protest petition under state rules.

“The planning commission does have a recommendation of denial,” staff said, and added that if the Board overrules the planning commission in this case a supermajority is required; staff said the presence of a protest petition means approval would need four of five votes (effectively a 0.75 threshold under the statute described in the packet).

Staff also noted that the Board could send the matter back to the planning commission with directions (likely delaying the next hearing to September), or deny in line with the planning commission. Several commissioners expressed preference for more information before making a final determination and the applicant requested a short continuance to August 5.
