Board tables deck request at 7th Avenue after applicants asked to correct paperwork

The Old Orchard Beach Board of Appeals on July 2026 tabled an appeal by applicants seeking relief to build a 10-by-20 second-floor deck at a 7th Avenue property, after the board found the filing mixed different relief types and lacked accurate dimensions.

Adam Goodwin, representing Tommy and Vanessa and identifying himself as from Carl Goodwin Incorporated, told the board the plan was “to decrease the rear from 20 to 10 and 0.5 feet, and the left side from 15 to 11 feet as well,” and said a window would be converted to a door to access the new deck. Neighbor Catherine Nye, who said she submitted a written opposition, told the board she had taken a day off work to attend and wanted assurance the board had received the letter outlining reasons to oppose the deck.

Board members questioned whether the matter before them was a miscellaneous appeal or a variance and noted the application as typed did not match what the applicant described. The chair concluded the paperwork was inadequate and the board gave the applicant the option to return next month with corrected materials. The board motioned and voted to table the item.

Next steps: the applicant must refile with corrected documentation and the board will reopen public testimony and make a final ruling when the item returns to the agenda.
