City staff on Tuesday briefed the Cedar Hill City Council on steps to comply with Texas Senate Bill 785 and proposed a new manufactured-housing (MH) zoning district that would allow HUD-code manufactured homes by right in a residential district.
"Texas Senate Bill 7 85 was from the 89th legislature and requires municipalities with zoning to provide new HUD code manufactured housing by right in at least 1 residential district or equivalent district," Director Self told the council, adding that the ordinance must "show the allowed areas on the zoning map." The staff recommendation was to create a new MH district, adopt associated development standards, and initiate a city-initiated rezoning for two parcels listed as 541 Simmons Way (also appearing in records as 541 Simmons Drive).
Staff said the parcels total about 5 acres and are currently developed with manufactured homes; the owner has been approached and "has been in agreement with this direction, if supported by council." The building official clarified that nine of the units on the property are owned by the property owner and two are privately owned; the current configuration would remain a lawful nonconforming use if the district changes.
Council members pressed staff on outreach plans, infrastructure and density questions, and limits on city authority. "We have not outreached to any property owners because this would be something we want to get approval from city council from first," Director Self said, describing the standard rezoning notification process: property-owner notices within 200 feet on July 31, a newspaper notice Aug. 1, plan commission public hearing Aug. 18, and a city council public hearing and formal decision on Aug. 25. Staff emphasized the city cannot add extra requirements barred by the statute; redevelopment would still be subject to normal subdivision and development standards.
Action status: items to authorize creation of the MH district and to initiate the city-initiated rezoning for 541 Simmons Way/Drive are on the consent agenda for formal approval at a future hearing; staff said the ordinance drafting and public-notice steps will proceed only if council directs.
The council did not take a final vote on the zoning change during the briefing; staff recommended moving forward with the drafting and standard notice and hearing schedule.
