Council debates timing and scope of annexation agreements

Councilors spent substantial time debating Section M of the draft annexation policy, which would require an annexation agreement to address public improvements, open-space dedications, and density limits. One councilor said he read the draft as asking applicants to supply agreement terms early in the process: "I thought it meant we wanna know what they want ahead of time," the member said, and asked whether staff should require an early draft or a term sheet.

Staff and other councilors pushed back on the idea the city would force applicants to produce a finished agreement at intake. A staff comment noted the city would draft and ultimately negotiate the annexation agreement: "We're not gonna have them draft the annexation agreement. We will draft the annexation agreement... it'll be negotiation," a staff presenter said. Several councilors proposed revising the language to state that the city "will enter into an annexation agreement" and that the agreement "must include" the topics listed, rather than suggesting applicants prepare a complete agreement up front. The council asked staff to reword the section to remove ambiguity and return a clean draft for the Aug. 11 meeting.
