Jail meal procurement reversals leave commission defending process and savings

The Clay County Commission’s procurement process for jail meals became contested in late January and early February after a second bid was discovered post‑opening.

At the Jan. 27 bid opening one bid was announced from Cherry Street Grille at $5.75 per person. At the Feb. 3 meeting county staff advised the Board that a second timely bid from The Roadhouse had been submitted to the Sheriff’s Office but was inadvertently not delivered to the Commission for the bid opening. The Board rescinded its earlier award, opened the second bid and accepted the low bid from The Roadhouse ($3.50/person). The vote to rescind and reconsider carried with one commissioner (Powell) recorded as voting nay on several procedural votes.

Later discussion in March covered Robert’s Rules, statutory requirements, and audit review. State's Attorney Teddi Gertsma told the Board she saw nothing improper with the Board's actions and the procedure ultimately saved the county an estimated more than $30,000, according to the minutes: "the Board's proper actions saved the County over $30,000," the minutes record, citing the State's Attorney and the Department of Legislative Audit review called by the Sheriff’s Office.

The final contract, bid amounts, and the Board's vote are recorded in the minutes and reflected in subsequent claims and payments.
