City planner explains nonconforming-rights rules and options under Denton code

Julie Waddett, principal planner with the City of Denton, told the Zoning Board of Adjustment that a "nonconformity is a land use or structure that was lawfully established, but no longer meets the current zoning or development standards." She walked members through Denton Development Code section 1.5.1 and related Texas statutes, outlining the types of nonconformities (uses, structures, lots and site features) and how each is treated.

Waddett emphasized that the city's regulations allow certain maintenance and repairs but generally prohibit increasing the degree of nonconformity. She described the discontinuance rule: if a nonconforming use is voluntarily discontinued for one year, the nonconforming rights cease unless the owner requests and the director grants a one-year delay supported by documentation (for example, evidence the property was marketed for at least six months during that year).

Waddett and staff also reviewed options available to property owners, including seeking variances from the board of adjustment, applying for rezoning to a district that permits the use, or seeking a planned development for unique sites. The presentation served as background for two appeals and variances on the evening's agenda.
