Board says lack of evidence key to denying appeal of land-use determination

Board members told one another they were constrained by the record when considering the appeal of the director’s land-use finding for 910 North Mayfield Road. The Chair said the appellant had not supplied sufficient evidence during the public hearing or in the appeal materials to justify reversing the administrative determination.

A committee member said specific evidence — for example, an interior photograph — would have been decisive. “I would take an interior photo that would have been enough for me to vote and take it to vote for the appeal, but there's just not—yeah. I can't vote,” the member said. The exchange showed the board weighed procedural record-keeping and evidentiary standards more heavily than substantive disagreement about the classification.
