Perry City staff presented a draft ordinance to vacate a portion of Hargas Hill right-of-way and explained the change was prompted by the Utah Department of Transportation.
"The ordinance was included in your packet," staff said, adding the vacated strip would be split into two parcels that, by state law, would be deeded 0.5 to each adjacent property owner. Staff also said there is no sewer in the portion to be vacated and the municipal waterline is along Highway 89, so utilities serving the properties would remain in the highway.
At a public hearing, Tristan Hart identified himself as representing the Flint family and said the plan appeared to cut off "0.5 of our driveway." Staff responded that the plat had been shifted so the vacating would start after the Gomez property and offered to work with the family and the developer, identified in the presentation as Link Construction (to be sold to Lennar Homes for building), to ensure driveway access is coordinated.
City staff emphasized the ordinance is written so it would not be effective until the subdivision plat is recorded, ensuring alternate routes and dedications are in place before any vacating is recorded. Council did not take final action at the hearing; the item will return on a future agenda for possible approval once staff and the developer complete coordination.
