MDOT presents maintenance agreement for Mountain Division Rail Trail Fryeburg segment

Dakota Hewlett of the Maine Department of Transportation reviewed a draft Maintenance and Operation Agreement for the Mountain Division Recreation Rail Trail, describing an upcoming 10-mile rail-trail project that includes work in Fryeburg and outlining respective Town and MDOT responsibilities.

Board member Jim Tyrrell pressed for clarity on surfacing best management practices and on a 'right to cure' clause in the draft that currently provides potential reimbursement or penalty obligations for the Town. Tyrrell asked whether comparable language could protect the Town if MDOT failed to meet its responsibilities; Hewlett said he would look into that request. Chair Greg Huang-Dale asked specific questions about herbicide application along rail lines and about removal of rails and invasive plants in the corridor; MDOT agreed to follow up.

The presentation did not include a formal vote. Town staff and MDOT will return with legal clarifications, including whether the agreement can be amended to add reciprocal enforcement language and specifics about vegetation-management practices.
