Board approves setback variances for addition at 412 S. 9th Street

Petitioners Corey Falk and Catherine Faulk asked the board to approve variances at 412 South 9th to permit an addition onto a legally nonconforming house. The requested relief would reduce the side yard to 3.8 feet (from 8 feet) and the front yard to 15 feet (from 25 feet).

The petitioners said parts of the house predate current standards and have existed for more than 50 years; they presented photos and described the need for more interior space and windows. Department staff recommended that any side‑yard relief be limited to the proposed addition only so future improvements would not expand nonconformity. After discussion a board member moved to close the public hearing and approve the petition with that condition and the board seconded and approved the motion.

"That is correct," a staff member said when asked to confirm the limited application of the setback to the principal structure. The findings as revised (dated June 26) will be included in the record as part of the permit process.
