A substantive point of contention during the special meeting involved when and how the city should secure the construction of recreational amenities on the parkland the developer will dedicate.
Staff recommended a condition requiring construction of amenities prior to issuance of the 157th residential occupancy permit. James told the commission, “So my recommendation for tonight is that you'll approve the sketch plan subject to 1 condition, and that is that the developer shall construct the recreational amenities proposed on the city parkland prior to the issuance of the 157th residential unit occupancy permit.”
The applicant proposed an alternate safeguard: require a financial bond at final plat tied to the 193rd single-family unit so the city holds funds to complete amenities if development stalls. Miss Perry explained the rationale: tying the obligation to bonding at final plat would mean "that money is already in place…should something happen with the market or the economy here and the rest of the project doesn't move forward." Commissioners expressed concern about the risk of delayed or unbuilt amenities if bonding or later triggers are accepted; the commission ultimately adopted the earlier 157th-unit construction trigger in its approval.
