James explained to commissioners that the proposed residential-heavy design differs from the comprehensive plan’s land-use expectation but that "it also does generally comply with the zoning and subdivision land development ordinances." He noted additional details will be required at the preliminary plan stage to ensure full compliance with the COA and ordinances.
Commission discussion referenced prior rezoning actions and parcels to the north owned by WVU Medicine that already provided some of the commercial acreage required under the annexation agreement; commissioners said remaining proffers and north-of-340 obligations will need further conversation with the property owner.
