Planning staff asked the commission to recommend approval of Resolution 2026-58 to extend the vested rights for the 4309 South Carothers subdivision from August 26, 2026 to August 26, 2027 to allow the applicant time to secure permits and begin site work. The approved plan (originally approved on Aug. 26, 2021) includes retail space, a butcher shop, and a convenience store with a gas station and pumps on a 5.35-acre site.
Staff told the commission that this is the second vesting-extension request for the site and that localized concerns had been raised by residents about the gas station use. Staff also noted that right-of-way and slope easement acquisition for a turn lane at the site entrance had been completed as of August 2023, and that if the vesting period lapses a new site plan would need to be submitted and reviewed under current standards; the applicant would likely need a variance to reduce the transitional buffer to align the entrance with Carothers Parkway.
Applicant representative Matt Huff (with Kimberly Horn) told the commission, "construction is expected to begin in the fall of this year," and said the applicant was not requesting changes to the approved site plan. After brief remarks the commission moved and voted unanimously to recommend the one‑year extension to the Board of Mayor and Aldermen.
