Opponents pressed that a 15% voluntary commitment is insufficient and asked the hearing examiner to require a written, enforceable MIHU commitment if the zoning action moves forward. In public testimony Stu Kohn told the examiner, "Constructing 260 apartment units to obtain only 39 moderate income housing units is not that meaningful," and asked that the record and any order clarify the level of commitment required by the county.
