Variance approved to place pond nearer ditch with 25-foot setback condition

The board approved a variance request permitting a property owner to place a pond closer to a county ditch by reducing the north-side easement from 75 feet to a 25-foot setback for the pond footprint, conditioned on filing plans and ensuring wetlands and permitting requirements are satisfied.

Applicant Matt Kolbeg said he is seeking a reduction from 75 to 25 feet on the north side to make construction easier and noted the pond would likely be located in upland areas. Jim, the board's staff presenter, recommended acceptance based on his review and told the board he "agree[d]" the 25-foot reduction "would not be an issue for me" and that the reduced easement would facilitate maintenance from the opposite side.

Board members emphasized the importance of top-of-bank measurements and wetlands permitting; the chair said the 25 feet must be measured from the top of bank so the county can run equipment in the event of future maintenance needs. The board voted to approve the variance and instructed the applicant to file plans and any required delineations and permits.
