Separately, the building commissioner reported he signed a use‑determination letter for a "best facility" sited in M1/M2 zoning pursuant to section 2.06 of the Joint Zoning Ordinance. The board attorney explained the commissioner’s authority to compare proposed use characteristics to listed uses (such as a utility substation) and issue determinations; the notice period for that determination began July 20, 2026. Board members asked about Department of Homeland Security jurisdiction and the limits of local authority; counsel confirmed DHS retains significant jurisdiction over certain facility types and that local zoning plays a role in siting decisions.
The board took no immediate additional enforcement action during the meeting and the building commissioner will continue to monitor compliance and next steps.
