Board reverses denial, finds Nashville residency for psychologist's owner-occupied permit

The Metropolitan Short-Term Rental Board of Appeals unanimously concluded on July 22 that, on the evidence submitted to the board, appellant Natalie Estatu resides in Nashville and reversed the prior denial related to her owner-occupied short-term rental permit.

Staff had flagged a quit-claim deed and a mailing address in Venice, Florida, together with Florida voter registration and a Florida professional license. Estatu responded with extensive local documentation, including Tennessee voter registration, a Tennessee driver's license, local utilities and medical records and ongoing Tennessee practice ties. "The objective evidence demonstrates that I do [reside at 2406 Alamita Street]," Estatu told the board, and she outlined caregiving responsibilities and licensing choices that explain ties to Florida.

Board members discussed legal effects of transfers to a trust and whether staff's invocation of the ownership-change provision and timing were dispositive. After reviewing the contemporaneous documentation and timing of deeds and registrations, the board voted unanimously to find that Estatu's primary residence is Nashville and to permit immediate reapplication; staff advised that she may reapply immediately.
