Council reviews retention‑pond safety proposal; cost, liability and HOA impacts flagged

Councilmember Zeke presented draft retention‑pond legislation proposing safety equipment (rescue rings/poles), riprap/erosion protection and aesthetic stone walls for ponds near arterial roads. He said the proposal was informed by standards adopted in other jurisdictions and by safety concerns raised by staff.

Council discussed whether existing privately owned HOA ponds should be exempt and who would bear retrofit costs if HOAs go defunct. Officials said a small number of ponds (roughly three or four near major corridors) would be affected and flagged the need for ODOT review where ponds sit within state right‑of‑way. Several councilors asked the sponsor to get engineer cost estimates and legal guidance on liability and implementation before bringing a final ordinance draft back to council.
