James England, presenting for staff, told the commission the easement request at 518 Fleming Street covers maintenance of a second‑story balcony and a portion of the building that encroaches into city right‑of‑way by about 167 square feet.
"This is an easement at 518 Fleming," England said, and walked commissioners through photos and a parcel map that show the balcony overhanging Fleming and Bahama streets. He said the application is similar to other balcony easements the commission has considered.
Lisa Keyhoe, who appeared for the applicant, said the property owner and contractor are working with HARC on concerns about beams associated with the balcony and that corrective work is ongoing. Keyhoe added that liability insurance would be submitted as soon as approval is granted. "Other than that, just here for questions," she said.
Commissioners asked whether the upstairs use would be residential or commercial; Keyhoe indicated the intended future use was unresolved but that the balcony itself likely would not be used. Commissioners also asked about the existence of a current easement and about annual fees. Staff noted there is not currently an easement and described the usual easement fee as a sliding scale related to square footage, commonly around $400 per year depending on size.
Accessibility questions were raised about whether the balcony impacts the pedestrian walking surface under it. Committee member Ryan said from his site visit he did not observe an ADA obstruction but suggested that dimensions be included in the record when the applicant returns. HARC and contractor comments about removing and restoring visible beams and brackets were also described in the discussion.
No final approval or vote on the easement was recorded at this meeting; staff and the applicant were asked to provide the additional clarifications and documentation requested by the commissioners.
