SPSA board amends procurement rules, raising small-purchase threshold

The Southeastern Public Service Authority board on July 22 approved a resolution to raise the authority thresholds in its procurement policy, moving the lower small-purchase threshold from $5,000 to $7,500 and clarifying that purchases between $7,500 and $100,000 will be handled via a three-quote small-purchase procedure while purchases above $100,000 will require a formal bid process.


General counsel Brent Spain told the board the proposed changes bring the written small-purchase procedure into alignment with the Virginia Public Procurement Act (VPPA) and with statutory adjustments that had increased the executive director's approval authority in recent years. "What is being proposed is that that bottom threshold go from $5,000 to $7,500," Spain said, noting the current small-purchase thresholds dated to 2012 and that statutory updates have since raised the director's approval limit.


Board members pressed staff on whether the changes would weaken competition in some procurements. Board member Stanton asked whether acquisitions above $100,000 might be suitable to limit competition in some cases; Spain and others responded that the VPPA allows narrow sole-source exceptions (for proprietary equipment or specialized professional services) but generally requires public competition. "There's certain things that are exempt," Spain said, "for example, legal professionals. You don't have to go through a competitive process for that."


The resolution reads that the board's procurement policy (attachment 1 to the resolution) is amended to account for inflation and to reflect the monetary thresholds described in the VPPA (section 2.2-4303(g)(1)). The board moved and seconded the resolution and took a voice vote; the board approved the policy amendment (voice vote; no roll-call tally recorded in the transcript).


Board materials and Spain's presentation trace the history of the thresholds: the Cosgrove bill in earlier years set a $30,000 limit that allowed the executive director to approve budgeted items up to that amount, and a 2021 amendment increased the director's authority to $100,000. Spain said the proposed policy change is limited to the small-dollar purchase section of SPSA's procurement policy and is intended to reduce administrative friction for day-to-day purchases already within approved budgets.


The board packet identifies the resolution on page 29 and includes redlined language showing the numeric changes. The board directed staff to implement the amended procedures and to continue following VPPA requirements, including any applicable sole-source provisions and the requirement to report the director's purchases to the board when appropriate.
