Council approves recording liens for unpaid rubbish collection fees

The Hawaiian Gardens City Council on July 22 adopted Resolution 021-2026 authorizing the recording of liens against properties with delinquent rubbish-collection charges.

City staff reported they received a list from the franchise hauler, Waste Management, noting several unpaid accounts. Under Hawaiian Gardens Municipal Code section 6.12.102, the city may record a special assessment against the real property served to recover unpaid rubbish charges, penalties and collection costs. Staff said Waste Management continues service while pursuing unpaid balances and that letters notifying owners have been sent; the council was told owners will have a minimum 10-day grace period after the resolution is adopted to make payments before a lien is recorded and that the list will be submitted to the county recorder by Aug. 10.

Council members asked whether Waste Management offers payment plans and who is responsible when a tenant fails to pay. Staff said the homeowners are ultimately responsible for trash bills because the lien is recorded against the property, although tenants may have accounts in their own names and may arrange payment plans directly with the hauler.

There were no public comments. After discussion, the council moved, seconded and approved the resolution unanimously.
