Austin commission orders demolition of unsafe house at 941 East 50th St

The Building and Standards Commission on July 22 adopted staff’s recommended findings and ordered demolition of a hazardous, unoccupied residence at 941 East 50th Street.

Code investigator Courtney Britt presented photographs and a history of inspections dating to July 2023, saying she documented 11 structural violations including collapsed and rotted porch framing, missing siding and foundation cracking, boarded windows and doors, and a compromised roof. Staff recommended that the owner obtain permits and either complete repairs or demolish unsafe portions within 45 days; if the city finds compliance has not been achieved by day 46, the code official may authorize city demolition and assess the costs as a lien on the property.

Owner representative Elia V. Escalante told commissioners the property is in probate and that she has been unable to secure the funds or authority to make repairs. "I agree with them about we have to demolish the structure," Escalante said, adding that she and an elderly relative visit the site periodically but lack resources for foundation repairs.

A niece participating by phone said she had not received earlier probate notices and that the family previously discussed selling or repairing the home; she asked the commission to consider whether restoration had ever been feasible. Staff and commissioners noted the probate status but said it did not change the code process: staff’s order provides a 45‑day window to pull permits and proceed; otherwise the city can move forward with demolition and recover costs.

Commissioners voted to admit staff exhibits and to adopt the order in full. Chair Michael Francis said a copy of the order will be mailed within 30 days. The order includes a 10% annual interest accrual on any assessed expenses and gives the city authority to dispose of debris after demolition.
