City says brief filed in zoning appeal over 455 and 465 Middle East; court will set argument date

The chair reported at the July 9 committee meeting that the city's brief in the dispute over properties at 455 and 465 Middle East has been filed on behalf of the Zoning Board of Appeals, and that the court will now set an argument date.

"My office filed our brief, the city's brief, on behalf of the Zoning Board of Appeals last week," the chair said. He added that the timing of oral argument is at the court's discretion and that staff will notify CPA commissioners when a date is set so commissioners can attend or prepare.

Committee members said they had seen little new activity at the site since the last meeting. One member reported regular drive-by checks and said the situation appears "stagnant" and "quiet" for now. Staff will provide further updates if the court sets an argument date or if field reports change.

No new enforcement action or hearing date was announced during the July 9 meeting.
