Calhoun County approves road‑use agreements with Pivot Energy and Key Capture Energy for solar projects

The Calhoun County Board of Commissioners on July 16 approved two road‑use agreements designed to fund repairs and protections for county roads affected by solar project construction.

County Administrator/Controller Kelli Scott told the board the agreements require developers to remit funds both at the beginning of construction and again at project completion to reimburse the Road Commission for wear and any necessary restoration. Scott thanked Road Department staff for helping develop the agreements.

The first agreement is with Pivot Energy; Commissioner Gary Tompkins moved approval and Commissioner Monique French seconded. The motion passed on a roll call vote, 5‑0, with Commissioners Derek King and Al Morehart absent/excused. The board then approved a similar agreement with Key Capture Energy by the same roll call tally. Scott said the agreements are intended to “protect the County's roads during and after construction” and noted the payments occur at two points in the construction timeline.

Kristine Parsons, Managing Director of the Road Department, was acknowledged for her work on the agreements and is scheduled to present on related road‑management topics at an upcoming County Road Association workshop. Scott also said Calhoun County continues to be a state leader in solar development.

Both approvals were ordinary business carried as part of the new‑business agenda; no amendments or recorded dissent were entered on the record. Each motion was approved by a 5‑0 roll call vote with two commissioners absent/excused, and both items were recorded as Resolutions (Res.082‑2025 for Pivot Energy; Res.083‑2026 for Capture/Key Capture Energy in the meeting minutes). The agreements require developer payments at start and end of construction and vest enforcement and accounting responsibilities with county road staff.

The board did not set additional conditions in open session. The agreements and related documentation were entered into the public record with the meeting minutes. The county indicated staff will monitor construction impacts and enforce the payment schedule described in the agreements.
