Iron County Commission postpones meeting after agenda failed to appear on state public notice site

At a meeting this morning, the Iron County Commission postponed its agenda and adjourned for two weeks after staff discovered the agenda had not appeared on the state's public notice website.

Commissioners raised the issue when a staff member said a caller told them the meeting did not show up on the state site. "I have evidence that it was posted to the public website, but I can't find it there," said Mister Riddle. Commissioners said that people who did not receive the notice "won't have an opportunity to speak to the items we're gonna be discussing," and called that a problem.

County counsel cautioned about legal risk and pointed to a statutory exception that may apply in some cases of technical failure. "When someone brings a suit to void a final action, there's an exception under part 1 b that says a court may not void a final action for failure to comply with the posting written notice requirements if there was an unforeseen technology failure," the staff member advising the commission said. Counsel outlined options: classify the incident as a technology failure, proceed but take no final action, postpone the meeting, or schedule a special meeting.

Commissioners discussed practical considerations: a funding-model briefing scheduled at 11:00 would have included mayors and school-board staff from several counties, and officials said they wanted to avoid wasting attendees' travel. The commission also discussed whether time-sensitive personnel items could be processed administratively and ratified at the next open meeting; counsel said administrative items could be ratified later and take effect then.

After weighing the options, the chair entertained a motion to adjourn and postpone the meeting for two weeks. The motion was seconded and approved by voice vote. The chair said the meeting would be postponed with apologies to those affected.

After the vote, staff said they had located the error in the posted date. "I posted it for the year 07/13/2022 02/02/2026," the staff member said, acknowledging an incorrect date entry that likely prevented the state site from displaying the agenda. The commission did not take final action on the agenda items and plans to revisit them at the reconvened meeting.
