Planning staff explained the Wyberg Subdivision request involves vacating a 10‑foot public utility easement along the rear and east sides of Parcel 04‑273‑0001; staff verified no utilities occupied the rear easement and said new perimeter easements will be dedicated where needed. After a public comment opposing development on historical takings grounds, the council approved the ordinance to vacate the easement by voice vote.
A similar ordinance to vacate an easement in the Bullen/Bowen Brothers Subdivision (site of the Wolfpack Commons commercial development) was approved with direction to condition the vacation upon recording of the amended final plat. Staff said the recorder’s office prefers an ordinance on title as a recorded instrument and that the conditional language would be added before signature.
The council also voted to adopt zoning text amendments for the 2500 North Gateway Commercial West zone after six months of planning commission workshops and public input. The amendments keep the corridor’s long‑term aesthetic and form‑based goals while allowing some heavier‑intensity uses back into the code as conditional uses, subject to new standards aimed at mitigating outdoor storage and fencing concerns. Planning staff said the planning commission gave a positive recommendation in June.
Finally, council approved the Harvest Acres development agreement. The subdivision is proposed as a bonus‑density single‑family project in the RE‑1 zone: staff said the proposal has 11 lots where base zoning allows 7, and the developer will provide off‑site right‑of‑way and utility improvements that support the bonus density.
All motions passed by unanimous voice votes. Staff said the Bullen/Bowen Brothers ordinance will be amended to make the vacation contingent on the recording of the final plat before signatures are finalized.
The council postponed the Beck Farm subdivision item for more discussion at a later meeting.
