The Lake County Board of Supervisors on July 14 heard a full de novo appeal of a Planning Commission denial of Pasta Farms’ request to amend a major use permit for outdoor commercial cannabis cultivation and related facilities. Planning staff described the project, its environmental review, oak mitigation proposals and a water availability analysis (senior planner presentation, SEG 5072–5199).
The applicant, Peter Simon, described the proposal to combine two previously approved permits and increase canopy to 30.11 acres. He emphasized mitigation measures including oak mitigation plantings and a water‑supply analysis by EBA Engineering; the applicant’s presentation noted a proposed oak replacement ratio under the Oak Woodlands Protection Act and described the proposed on‑site water storage (SEG 5116–5199).
Dozens of residents, tribal representatives, technical experts and community groups testified about cumulative impacts, groundwater sustainability, wildfire evacuation capacity on narrow local roads, and the cultural and recreational value of nearby sanctuary and retreat lands. A retained hydrogeologist (G. Frau / Geosyntech) presented data showing seasonal groundwater drawdown and warned that reported well levels did not fully recover after summer pumping; he concluded the available record did not demonstrate a sustainable water source for the proposed maximum irrigation (SEG 6899–6950). Fire‑safety witnesses described narrow choke points on Siegler Springs Road and urged a site‑specific evacuation analysis (SEG 6400–6468).
During deliberations the applicant offered a substantial modification: to withdraw the parts of the application that would require tree removal and new building construction and to resubmit those elements later if desired. County staff then proposed amended conditions of approval that remove the timber‑harvest and tree removal conditions and require the applicant to provide amended site plans and a revised property management plan prior to finalization of the board’s findings (CDD staff, SEG 7121–7144).
County counsel proposed motion language; the board voted to grant the appeal in part on modified terms and directed the applicant to submit the amended project description, site plans and property management plan to Community Development within 30 days. The board also directed the appellant to provide a supplemental written statement describing the grounds of appeal (to make the appeal filing complete) within the same 30‑day period. The motion passed by recorded vote (motion offered and seconded; minutes show vote recorded as 4–0) (SEG 7299–7307).
The board left open enforcement and monitoring tools (annual compliance monitoring, ability to revoke permits) and public commenters pressed for stronger proof of sustainable groundwater, cumulative impact analysis and formal evacuation studies. County staff confirmed that mitigation measures discussed (oak replacement plantings, water storage tanks, on‑site water monitoring) remain in the record but asked the board to require the applicant’s amended materials so staff can incorporate final conditions and findings.
The applicant’s concession to remove tree removal from this approval narrowed the immediate environmental issue; surrounding community groups and technical witnesses urged continued scrutiny of water use and evacuation capacity if the applicant later resubmits building/tree work.
