Board orders removal or correction of industrial equipment at 2805 11th Avenue within 30 days

The Code Enforcement Board on July 8 issued a Board order requiring removal or correction of industrial equipment at 2805 11th Avenue within 30 days, or continuing civil penalties of $50 per day would commence after the original compliance date.

Code Enforcement Officer Melody Sanderson reported the citation (issued April 17, 2026) involved a double-axle flatbed trailer, other trailers and a large spool of cable; no hearing request was received and the violation was deemed admitted. The civil penalty has been paid but the property remained noncompliant as of the hearing.

Jinquan Lin, sworn in and appearing for his father, the property owner, said he paid the penalty on June 11, 2026 and contacted the tenant — a subcontractor on an Indian River County fiber-optic project — who began removing items the same day. Sanderson showed photographs of items still on the property and added them to the record.

Chairman Eric Price moved that the Board find a continuing violation and issue a Board order to correct the violation within 30 days from the date of the Board order or continuing civil penalties of $50 per day shall commence the first day after the original compliance date of June 12, 2026. Mr. Ken Daige seconded and the motion passed unanimously.

Staff will monitor compliance and return the matter to the Board if removal is not completed within the ordered timeframe.
