Board keeps 26 Pond View Lane pool variance open pending landscape plan and DEC renewal

The Zoning Board of Appeals kept the public hearing open July 10 for an application from Eleanor F. Adams for a swimming pool and patio at 26 Pond View Lane after village staff raised site concerns and the applicant said a DEC permit renewal is pending.

Applicant representative Trevor Darryl explained the board had approved the same pool location in 2012, but changes to the village code since then mean the project now requires relief from front- and side-yard setback standards. Village staff member Billy Hajek disclosed prior representation of the owner before the DEC in 2012 but said he did not feel conflicted about commenting; he urged the applicant to avoid disturbing a street tree near the proposed driveway and suggested screening along Pond View because the pool now lies in the front yard under current code.

The board asked for a landscape plan showing the driveway revisions and confirmation that the village tree would not be disturbed. The applicant said they will submit a landscape plan and that the DEC renewal for the wetlands permit is pending. The board left the hearing open and told the applicant to provide the requested materials before the next meeting.

No vote or formal determination was taken July 10.
