Commission forwards Hosta Hochi rental policy to council after debate over cancellation language

Staff presented resolution R-89-26, a draft rental policy for the Hosta Hochi facility; staff said the draft incorporated prior commission direction and legal and administrative edits to address the building’s kitchen, technology and learning rooms.

Several commissioners asked whether the policy’s verbiage matches other city facility policies and how city staff would exercise the authority to cancel a reservation. Commissioner Heidi asked: “Is this ver, verbiage similar to the verbiage for all facilities and parks in Fitchburg? Or is this different?” Staff replied the draft was modeled on community center, senior center and library templates but contains additional wording because Hosta Hochi is an indoor, complex facility and that actual cancellation decisions would be handled case-by-case by multiple staff after consultation.

Commissioners also discussed hypothetical free-speech implications of canceling a reservation if outside groups subsequently protest or disrupt an event. Staff and a commissioner said the draft had legal review and intended to leave discretion for staff to decline or cancel reservations only in circumstances such as likely violation of laws, property damage, or public-safety concerns.

Some commissioners argued the added language should be considered for all facilities so rules are uniform; others said the commission should forward the current draft now and consider broader uniform adoption later. A motion to recommend the Hosta Hochi rental policy as presented was carried by the commission and will move to council for final approval.

What happens next: The policy will be forwarded to the council for consideration. Commissioners asked staff to track examples of how cancellation authority is used so the commission can evaluate cross-facility consistency in the future.
