Commission recommends 2026–27 fee schedule to council, asks staff to remove inapplicable fees

The Emigration Canyon Planning Commission on July 9 recommended that the City Council adopt a consolidated 2026–27 land‑use fee schedule but asked staff to remove items that do not apply to Emigration Canyon, such as short‑term rental and sexually oriented business license fee tables and references to other jurisdictions.

Staff member (Speaker 3) presented the proposed schedule, saying it consolidates departmental fees and adjusts several charges to reflect operating costs: “So what we did first was change the reinspect fee from $50 to $100 and then the overtime after‑hours inspection from $1.20 to $1.50,” the staff member said, noting the changes are intended to cover time, fuel and vehicle costs for inspections in outlying communities.

Commissioners dug into plan‑check and valuation details; staff explained the plan‑check fee is calculated as 65% of the building permit fee and that customers receive up to four review cycles before additional plan‑check charges apply. The staff member also said engineering plan‑check fees were restructured from a percentage of bond amounts to scaled flat fees so small or bond‑less projects are charged more proportionately.

Several commissioners raised concerns that the master schedule contains entries irrelevant to Emigration Canyon — including license and fee entries tied to other MSD jurisdictions, references to UDOT permits where the city has no state roads, and the short‑term rental and sexually‑oriented business (SOB) tables. Chair (Speaker 2) said the Commission’s intent was to recommend the consolidated schedule but to have staff “cleanse” the Emigration Canyon version so it omits non‑applicable items and removes cross‑jurisdictional references.

Commissioner (Speaker 4) moved that the Commission recommend approval of the 2026–27 land‑use fee schedule to the City Council, subject to edits removing short‑term rental and SOB license tables, references to UDOT and other MSD municipalities, and other irrelevant language. The motion was seconded and approved unanimously.

The Commission’s recommendation will be transmitted to the City Council; staff said the council retains the authority to adopt the schedule with additional changes. The Commission also asked staff to provide a clear, city‑specific fee table (or a highlighted clean copy) so the public can see which fees apply in Emigration Canyon.
