Commission recommends code changes to council; conditional-use replacement passes 4-1, fee schedule continued to July 9

The Emigration Canyon Planning Commission on June 11 recommended two proposed code changes to the Emigration Canyon Council and acted on a separate fee-schedule item.

Planning Manager Brian Tucker presented an ordinance to enact Chapter 19.03, titled "Development Agreements," and a related ordinance to repeal and replace Chapter 19.84, "Conditional Uses." Commissioners discussed formatting, titles and cross-references in the municipal code and reviewed a council resolution/adopting-ordinance approach that would apply to both chapters. Commissioner Jodi Geroux provided written comments that were discussed at the dais.

For OAM2026-001637 (Chapter 19.03), Commissioner Geroux moved to recommend the ordinance to the Emigration Canyon Council with adjustments to formatting and adopting language; Commissioner Jim Karkut seconded. The motion passed unanimously.

For OAM2026-001638 (replacement of Chapter 19.84), the commission opened and closed the public hearing with no public testimony. Commissioner Geroux moved to recommend the replacement with reformatting and reference checks; Commissioner Dale Berreth seconded. The motion passed with Commissioner Andrew Wallace casting the lone vote against the recommendation; the other commissioners voted in favor.

Separately, the commission continued OAM2026-001636 (a resolution amending Emigration's land use fee schedule) to the July 9 meeting after a presentation from Brian Hartsell; the motion to continue was made by Commissioner Wallace and seconded by Commissioner Geroux and carried unanimously.
