Resident's sound-barrier fence request referred to Planning and Zoning after council review

Natalie Howard's request for a variance to install a sound-barrier fence was discussed July 7 and sent to the town's Planning and Zoning commission for further review.

Council members and staff examined a layout showing a fence run from a house corner that would cross back to the property line and noted the primary concern is preserving the sight triangle and public safety at the corner. A council member who reviewed the property said the proposed alignment "is not even close to inhibiting traffic" but stressed that Planning and Zoning should examine the setback and safety implications.

Staff explained that ADA issues may factor into the variance process and recommended that the town lawyer, ADA experts and Planning and Zoning see the application first. Several council members emphasized the proper sequence: Planning and Zoning first, then the council if an appeal or recommendation requires action.

The council did not make a final determination on the variance; instead the item was placed on the Planning and Zoning agenda for a public hearing and legal/ADA review.
