Loren Martin, chair of the Boscawen Planning Board, said the Board conditionally approved a two‑lot minor subdivision and its Conditional Use Permit for Riveredge Properties LLC at 254 King Street during the July 7 meeting.
Tom Berkeley of Riveredge Properties explained that the proposal leaves the parent parcel intact while creating a new one‑acre lot with 100 feet of road frontage; 235 feet of frontage would remain on the parent parcel. Berkeley said the applicants have applied to the state for a new driveway but understand the state may require a shared driveway, in which case the driveway would be placed on the common property line. Web Stout confirmed the proposed driveway meets the state's minimum line‑of‑sight requirement and noted some undergrowth would be trimmed to meet sightline standards.
PCD Director Kellee Jo Easler told the Board the Conditional Use Permit had been omitted from the public notice and the Board then determined the application had no regional impact and accepted it as complete with waivers pending review. Vice Chair Barbara Randall moved to conditionally approve the Conditional Use Permit on the basis that the proposal meets the ordinance and Land Development Regulations; the motion was seconded and carried unanimously.
The Board also granted the applicant’s requested waivers, including relief under Section 6.5.17 and Section 6.4.3.H. The Minor Subdivision was conditionally approved with six explicit conditions: record an easement deed for the shared driveway with the subdivision plan; add permit numbers and dates received to notes 9, 10 and 11 on the plan; include professional stamps, signatures and owners’ signatures on the final plan; list all waivers granted and conditions of approval on the final plan; obtain receipt of all state and local permits; and apply impact fees. The conditional approval is contingent on satisfying those conditions and receipt of any required state permits.
No abutters spoke in opposition; Adam Ayers, an abutter at 250 King Street, raised a separate concern that his shed slightly overlaps the property line and Berkeley offered to work with him to resolve the issue. The Board closed both hearings and voted unanimously on the motions described above.
The Board’s decision will become final once the listed conditions are satisfied and required permits and recordings are completed.
