Council denies rezoning request for 1680 West 3000 South

The Daniel Town Council voted on July 6 to deny a request to rezone 1680 West 3000 South from RA-5 to commercial.

John Call, the property owner, told the council he requested the zoning change to reflect long-term planning shifts caused by nearby airport expansion and its associated safety/buffer zone. "We're only asking to be consistently treated as the others," Call said, arguing the parcel had been designated commercial in previous planning materials and that the request was not spot zoning.

A neighbor, Fred Bensler, spoke in support of Call’s request, saying he would like his own property to be considered in the same manner. After public comment, a council member moved to deny the rezoning; the motion was seconded and passed in the recorded vote.

Mayor (chair) read the planning and hearing process aloud before and after public comment. The owner repeatedly emphasized that the request sought consistency with other parcels already rezoned within the airport planning area; council members focused on zoning policy and the planning commission’s prior review during deliberations.

The denial leaves the property's zoning as RA-5. The council did not adopt an alternative rezoning or impose new conditions for the parcel during the meeting. Any future application would need to return to the planning commission and follow the public-notice and hearing process required by town code.
