Independent candidate says she will file AG complaint, alleges county attorney misrepresentation

An independent candidate told the Hunt County Commissioners Court on July 6 she will file a formal complaint with the Texas attorney general alleging problems with county handling of public information requests and a county civil attorney’s conduct.

"I've just filed filed the election ballot lawsuit," Carol Anne Davis said during public testimony, and she told the court she would not discuss the lawsuit's details in open session. Davis named the county’s civil attorney, saying he and an associate have shown "personal animus" toward her in their handling of Public Information Act requests and that the attorney misrepresented facts to the attorney general in one case.

Davis also raised concerns about the county’s Open Records Act compliance and said the county’s current approach — relying on a mandatory electronic form and not publishing direct email addresses — leaves requesters disadvantaged. "Bottom line is right now I don't believe the county is in compliance with the open records act because of the fact you want people to use an electronic form, you do not publish email addresses," she told commissioners. She said she would be filing a formal complaint with the attorney general.

Judge Jo Judge Stoval closed the public testimony after Davis spoke and the court proceeded to scheduled budget items. The court made no public response to Davis's allegations during the session.

The candidate named the county civil attorney in her remarks; commissioners and county staff did not respond during the meeting and did not announce any immediate investigatory steps on the record. The office of the attorney general maintains an online complaint process for alleged public-information violations; Davis said she planned to use that route.
