Commission recommends R4 zoning for two Burger Road properties to preserve existing nonprofit and medical uses

A commission voted unanimously to recommend that the board of commissioners approve initial R4 (high-density residential) zoning for two properties at 435 and 485 Burger Road.

A city staff member told the commission the two sites, totaling about 30.78 acres and currently undergoing annexation into Paducah City, include the Marman House and the Mountain Comprehensive Medical Facility for Mental Health. "The R4 zone would allow both uses to continue as they are as opposed to becoming nonconformities," the staff member said, and recommended the commission adopt the zoning designation.

Commissioner Rhodess moved that the commission recommend approval to the board of commissioners and adopt findings in support of the R4 designation, citing the Paducah City and McCracken County comprehensive plan and municipal order MO 3028 as policy support. The motion’s findings noted that R4 would provide a buffer between commercial uses and single-family homes, that the current nonprofit and medical uses are principally permitted in R4, and that the zone would prevent future high-intensity commercial development that could alter neighborhood character.

Commissioner Kaylor opened and closed the public hearing on case Z2026-0101; no members of the public spoke. After the motion and a brief clarification to confirm the correct zoning code (R4), the commission recorded a roll call vote: Commissioners Rhodess, Benberry, Griffin, Kaylor and Chairman Wade each answered "I," and the recommendation passed among those voting.

The commission’s recommendation will be forwarded to the board of commissioners for final action. The meeting was adjourned at approximately 5:37 p.m.; the next meeting is scheduled for August 3.
