The Office of Commercial Space Transportation (AST) released a recorded overview of the federal commercial-space licensing process, explaining who needs authorization, what kinds of approvals exist, and how AST evaluates applications. The presentation emphasized public-safety limits on AST's authority and the technical requirements applicants must meet.
AST staff said the office is "authorized under Title 51 of the U.S. Code" to authorize launch and reentry operations and to operate launch and reentry sites, as well as to issue safety element approvals and independent payload reviews. The presenter added, "Note that the FAA does not certify the safety of space vehicles or regulate mission assurance, and is only authorized to regulate the operations in regard to public safety." This distinction, AST said, narrows its regulatory role to protecting people and property rather than certifying vehicle designs or mission assurance practices.
AST described several authorization paths: vehicle-operator and site-operator licenses for U.S. entities (including U.S. entities operating abroad), experimental permits for reusable suborbital research and development, separate safety element approvals, and independent payload reviews that can be integrated into a provider's authorization. The presenter said a safety element approval "may be issued separately from a license but does not authorize activities for which a license is required."
The agency urged early planning for the required technical work. Applicants must perform a program-specific, risk-based analysis showing that risk to the public remains within regulatory limits. "Preparations for the risk analysis should be considered in the early planning stages of a project," the presenter said. AST also warned that a single incident that causes public injury or damage to public property could have industry-wide consequences.
AST explained process timing: an initial pre-application discussion helps determine the correct regulatory path; the pre-application stage has no defined timeline and "progresses at the pace of the applicant," with applicants sometimes remaining in pre-application for weeks or years. Once AST accepts an application for review, the project enters an evaluation stage with a 180-day review period in which AST evaluates compliance materials, performs policy reviews for vehicle-operator licenses, and applies payload and financial-responsibility reviews if a license is issued.
If a license is granted, the operations stage includes compliance monitoring, safety inspections, and ongoing mitigation identified in environmental reviews. The presenter said the license period "is up to five years and may be renewed or modified by submitting an updated application."
AST also noted that the FAA does not license launches or reentries wholly controlled by the U.S. government, though government payloads increasingly fly on commercially licensed missions. Applicants may need additional approvals or coordination with other agencies; for example, those using radio-frequency communications must contact the Federal Communications Commission for appropriate licensing. AST made clear that coordination for any additional required licenses is the responsibility of the applicant and directed viewers to contact the AST pre-application team with questions.
The presentation cited the governing authorities for applicants: Title 51 of the U.S. Code and commercial space regulations in CFR Title 14, Volume 4, Chapter III, Part 400. The overview presented procedural milestones and clarifications intended to help prospective operators, while repeatedly underscoring the agency's statutory focus on public safety rather than vehicle certification.
