Tallahassee commission delays action on Southwood road enforcement, directs broader hearing for Aug. 28

The Tallahassee City Commission on July 6 postponed a quasi‑judicial enforcement hearing over an uncompleted Orange Avenue extension in the Southwood development and directed staff to renotice a broader hearing for Aug. 28.

The commission convened the special public hearing after the city issued notices of violation on June 16, 2026, saying the Southwood development order required construction of an Orange Avenue extension by Dec. 31, 2025. City staff told commissioners about roughly 900 feet of uncompleted roadway that sits on land now owned by NextGen Family Group LLC and said design work for the segment is about 90% complete, pending resolution of right‑of‑way and title issues.

Neighborhood leaders urged the commission to go beyond targeting a single parcel. "If this situation does not deserve sanctions, nothing else does," John Ray, who said he represents a coalition of roughly 600 Southwood residents, told the commission. Ray argued sanctions should cover all undeveloped parcels adjacent to the unbuilt Orange Avenue and the nearby Builtmore Avenue because those parcels would rely on the same road network.

St. Joe Company, identified by counsel Robert Vulpi as the project’s primary developer, asked the commission for more time and said it has been negotiating with NextGen for an easement or right‑of‑way. Vulpi said St. Joe filed a quiet‑title lawsuit on June 25 to resolve deed problems and that the company is willing and prepared to construct the roadway once it obtains the necessary legal access. "We're actively trying to build the Orange Avenue extension," Vulpi said, adding that engineers have produced approximately 90% of the design.

Commissioners split over legal and practical questions: some members urged immediate sanctions limited to the parcel containing the unbuilt segment, while others said expanding sanctions to multiple development "pods" would better protect Southwood residents and prevent further approvals that would add traffic to makeshift roadways. City attorneys and staff warned that expanding the geographic scope of punitive measures would require additional notice and factual findings and could trigger fresh procedural timelines.

Faced with those legal constraints, Commissioner Dian Williams Cox withdrew an initial motion to adopt a resolution that would have suspended permitting on the NextGen tract and instead moved to postpone and direct staff to issue new notices that could include other affected parcels across the Southwood DRRI. Mayor Pro Tim seconded the motion. The motion passed 3–2, with Commissioners Matlo and Porter dissenting.

Commissioner Matlo, who voted against the postponement, said the Orange Avenue segment already in use presented an immediate public‑safety and traffic problem and favored limited sanctions against parcels served by that roadway. Commissioner Porter likewise expressed concern about delaying relief for residents and asked how sanctions would be lifted; staff said suspensions would remain until the violation is cured or until the commission provides different direction.

The commission discussed scheduling the renoticed hearing for the regularly scheduled Aug. 28 meeting and holding the item in the evening to accommodate residents. In the meantime, staff will prepare notices and the evidentiary record required to support any expanded enforcement action. The commission did not adopt punitive measures on July 6 and left open whether sanctions will ultimately target NextGen, St. Joe, other adjacent owners, or some combination, depending on what staff’s factual showing establishes.
