Greenwood council approves annexation ordinance after trimming bridge requirement and adding plan‑commission findings

The Greenwood Common Council voted unanimously to adopt Ordinance 2619 on second reading, annexing approximately 193.27 acres at the northeast corner of Whitland Road and County Road 200 West and adding the advisory plan commission’s findings to the ordinance.

Eric Brown, speaking on behalf of the petitioner, told the council he and his client accepted most of the eight conditions forwarded by staff and the Plan Commission but objected to a condition that would require construction of a bridge as part of the development. Brown said the land to the east is still in county jurisdiction and cannot currently be served by the sewer configuration shown on the petitioner’s plans; he offered an alternative: a restricted donation the city could hold in escrow (Brown initially proposed $100,000) to be used if and when the bridge becomes necessary.

City staff, represented in the discussion by Mr. Nelson, urged the council to retain at least one bridge requirement. Nelson said the recommendation reflected the comprehensive plan and unified development ordinance, which ask staff and council to consider likely future connectivity and off‑site impacts, not only the immediate project’s footprint. He also explained that the Alexander ditch is a legal drain under the county surveyor’s jurisdiction, and any crossing would require county approvals and ongoing maintenance considerations.

Council members asked whether the county could refuse a bridge over the legal drain and discussed who would be responsible for long‑term maintenance. A council member noted staff and prior advisory reviews had shown the bridge on the conceptual plans and argued building one now could remove a hurdle to development and might cost roughly $500,000; others said an escrowed fund could be a compromise if the council required conditions tying the money to a timeline or refund provision.

After debate and several procedural amendments — including adding the Plan Commission findings and later adjusting conditions related to the bridge and materials (a “no‑vinyl” condition was added) — the council approved the ordinance as amended on a recorded vote of 7–0.

The ordinance’s final terms reflect compromise language negotiated during the meeting; the council’s approval advances annexation and allows the petitioner to proceed under Greenwood’s development review path, subject to the amended conditions and any required county permits for a future crossing.

The council did not set a specific schedule for construction of any future bridge; multiple speakers recommended that if the council accepts an escrowed donation or other financial substitute, it should include clear trigger conditions and timelines so funds are released only when construction is genuinely required.
