County accepts reduced warranty bond for Grass Valley subdivision, cutting bond from $2.84M to $25,000

Missoula County commissioners approved a staff recommendation Jan. 30 to accept a reduction of the developer's subdivision bond for the Grass Valley Industrial Park from $2,835,624 to $25,000.

County staff explained the developer—identified in the record as Grass Valley Industrial Park LLC—has constructed the required public infrastructure and the public works department recommended holding $25,000 for the one‑year warranty period against defects. The original bond had been provided by Philadelphia Indemnity Insurance Company and county staff said acceptance of the decreased amount is consistent with public‑works acceptance of the improvements.

A staff presenter described that, as with other public improvements, the developer is required to warrant the work for one year and the county plans to establish an RSID for maintenance after acceptance. The board moved, seconded and approved the staff request by voice vote; individual tallies were not recorded in the transcript.

Staff noted the county will proceed with establishment of the RSID and that lot owners retain protest rights under the RSID process.
