Randy Maxey told the Cabell County Commission on Oct. 22 that he wants to acquire an abandoned road that runs along his property and the Foxfire Resort.
Maxey said part of the roadway had already been purchased by I.V. Cunningham through the state and that District 2 had informed him it could not purchase the remaining portion. "There is a Prescriptive Easement that can be done for the sale of the property," County Attorney William Watson said after reviewing the matter.
Commissioner Jim Morgan asked how the first piece of the road had been sold. Commissioner Kelli Sobonya said she thought the commission should assist. President Nancy Cartmill said she would look into the situation further and get back to Maxey.
No formal motion or vote was recorded on the request; the transcript records that the president committed to follow up with the resident. The commission did not set a date for a report-back or a formal next step during the meeting.
