Board approves deck reconstruction variance; staff to require as-built verification

The Board of Adjustment voted unanimously to approve a practical-difficulty variance permitting reconstruction of a low deck at 2702 Passeril Way in its existing footprint, which staff said is approximately 0.5 feet from the southern property line.

Staff framed the request as a footprint replacement accelerated by storm damage: the existing deck had been in place since at least the 1980s and suffered accelerated deterioration in 2024 storms. Staff recommended conditions to preserve percolation (permeable surface or grading to keep runoff on-site), to space deck boards to allow thermal expansion (minimum 1/8-inch gap), and to submit a final as-built survey demonstrating the deck is replaced in the same footprint.

Applicant Sharon Angelo said the deck could not be seen from the street, had historic placement on the lot and was being replaced as-is; she reported the contractor adheres to tighter spacing (3/16 inch) than the 1/8-inch minimum and expressed concern about the expense of a new survey. Staff acknowledged the cost concern and discussed options for verification while emphasizing the need for a licensed as-built survey to prevent after-the-fact departures from the approved footprint.

After limited public comment (none), the board approved case number 26071 with the staff conditions. Roll call was unanimous: Member Schmidt, Vice Chair Core, Member Kunzer, Member Small and Chair Chase voted yes.

Staff will require the as-built survey at permit closeout to verify the deck meets the approved conditions and spacing guidelines.
