Council accepts planning commission denial of R3 zoning change for 1505 Lynx Avenue

Webster City Council voted to accept the Planning & Zoning Commission’s recommendation to deny a proposed amendment to the R3 zoning district that would have allowed commercial personal services at 1505 Lynx Avenue.

Planning staff reported the commission’s Jan. 12 meeting and its recommendation to deny the applicant’s request after hearing legal guidance that the R3 code could not be changed only for a single property (spot zoning). Staff and an attorney present told council that allowing the proposed uses would require amending the R3 district citywide and would require a public hearing and ordinance-change process.

The business owner who sought the change told council she had obtained required state licensing and a health inspection and presented a petition claiming roughly 130 signatures in support. She said the property had been marketed for sale for years and that zoning restrictions prevented prospective tenants from opening certain businesses there.

Staff clarified the options: accept the PNZ recommendation (deny the request), or direct staff to draft a citywide R3 ordinance amendment and schedule the public-hearing process. Councilors discussed the potential community impacts and the limits of spot zoning before moving to accept the PNZ recommendation. The motion to accept the denial passed on roll call (all council members voting yes).
