The Porter Board of Zoning Appeals approved a variance on June 24 permitting an existing accessory structure to remain on a lot before construction of a principal dwelling, with conditions designed to prevent the lot from being sold as an accessory-only parcel.
Petitioner Brian Lundowski said he already has preliminary septic approval and that the accessory building would be incorporated into a later residence. In public comment, William Lopez asked that the board require construction to begin within 12 months; board members instead approved a longer, specified timetable and the ability to request an extension for good cause.
The motion conditions the variance on applying for a permit and beginning construction by Aug. 1, 2027, or returning to the board for a one-year extension showing good cause. The board also directed staff to record findings and the written commitment tying the variance to the successful subdivision approval; the variance was made contingent on the plan commission and subdivision process moving forward.
The motion passed on roll call 4-1.
