Planning staff told the board the Latson Road parcel is 232 feet wide and that the request seeks to reduce required side-yard setbacks for nonresidential use adjacent to residential zoning from 50 feet to 20 feet. Staff said the zoning and buffer standards (section 13.2) could address nuisance concerns and that the request met the variance findings.
"Based on the facts presented, the analysis staff finds that the application meets the requirements for a variance based on the findings provided and therefore recommends approval of the request," Planning staff said. The staff presentation noted the applicant plans an urgent care center and a quick-service restaurant.
No members of the public spoke in opposition, and one board member moved to approve the variance "based on the facts and findings of staff"; another member seconded. The board voted by the usual signs and recorded unanimous approval.
Planning staff said required buffering and planting standards still apply and that landscaping, fencing or other buffering measures would be used to reduce impacts on adjacent residential properties as required under section 13.2.
The variance is approved and the applicant may proceed with permitting and site-plan work subject to standard buffer and site-development requirements.
