The Sanibel Planning Commission approved a variance Tuesday permitting a residential dock with two boat lifts at 5270 Indian Court that extends more than 15 feet waterward of the mangrove root line and allows docking in an area with less than 3 feet of water at mean low water.
Kim Ruiz, principal planner, told commissioners the application (PL20260025), submitted by Rachel Thomas on behalf of Gaeta Partners LP, met the city’s seven variance standards. Ruiz said staff found the design “is the minimum necessary to accommodate a boat dock with 2 boat lifts” and that 91% of the shoreline would remain undisturbed. She recommended approval with three conditions outlined in the staff report.
Natural Resources staff said the property lies adjacent to mangrove shoreline and the city enforces a mitigation regime when mangroves are altered. Dana Detmar of Natural Resources explained the code requires replacement at a 2-to-1 ratio for any canopy lost, noting that mitigation often uses a larger number of smaller plants when mature trees are not available.
Payson Osman of Stokes Marine, representing the marine contractor, described a red string on the site as the marked limit for mangrove trimming to provide lift access. "That indicates the eastern side of that smaller pier, showing the limits of the impacts to the mangroves in the trim line," he said.
Commissioners asked whether the proposed slips would be navigable and whether trimming beyond minor canopy trimming might be necessary for access. Detmar said the code allows trimming for access and that staff usually evaluates the precise trimming need after the dock is installed as part of the development-permit review.
Commissioner Coulter moved to approve Resolution 26-15 (PL20260025) to allow the waterward extension and the limited-depth docking at 5270 Indian Court, subject to the three staff conditions; the motion was seconded and carried unanimously.
The approval delegates final execution of the resolution to the chair and does not return the item to the commission unless conditions change. The decision includes the conditions listed in the staff report and notes that additional review of mangrove access and trimming will occur through the development-permit process.
