The Hamilton County Drainage Board on June 8 approved a large slate of non‑enforcement requests covering fences, landscaping, pole replacement and minor structures across multiple drains, and took several related administrative actions.
Staff presented individual non‑enforcement requests (many for fence replacements) on drains including Thistlewaite, Stahl Dredge Arm, Intercoastal at Geist, Williams Creek, George Seybold, Crooked Creek, Vestal‑Kirkendall and Towne Lake, among others; staff recommended approval for each case and the Board approved them unanimously.
The Board also addressed two non‑enforcement matters tied to utility work and lift stations. For the Fred Seeright Drain and a proposed Hamilton County Regional Utility District lift station at 256th Street, staff recommended converting previously approved items to a subdivision non‑enforcement; the Board approved the subdivision non‑enforcement subject to future ratification.
For the Emily Vestal Drain and Noblesville Sanitary Sewer Lift Station #20, staff noted the materials were received only the prior week and that more review time would be preferable; nonetheless the Board approved the non‑enforcement as presented, with the Surveyor noting staff would continue to review plans.
The Surveyor also reported a stop‑work order for INCOG Real Estate Holdings had been resolved and that a letter rescinding the stop‑work order was signed that morning.
Why it matters: Non‑enforcement decisions and subdivision non‑enforcements formalize how the county handles minor encroachments and utility infrastructure inside regulated drain easements. Approvals limit immediate enforcement while documenting conditions; subdivision non‑enforcement for the lift station will require later ratification and oversight.
