Cocoa Beach advances ordinance to formalize lien reductions for dilapidated properties

The Cocoa Beach City Commission on voice vote advanced Ordinance 1716 on first reading, establishing a formal process for property owners or prospective buyers to request reductions or releases of code‑enforcement liens when properties are brought into compliance.

Brian Palmer, deputy director of development services, told commissioners the measure "just establishes a formal process for individuals to come in and to ask for a reduction or a release of the code enforcement lien," and said the change is intended to help rehabilitate dilapidated properties that otherwise sit unsold because liens deter purchasers. The ordinance includes stipulated actions an applicant must take before requesting relief.

During public comment Janice Scott of Cocoa Beach voiced concern about frequent lien forgiveness and asked the commission to "take a look at the devil's in the details" to ensure the city is reimbursed for code‑enforcement costs. Rick Anderson of Minute Maid Causeway said he agreed with the goal of refurbishing properties but worried the measure "doesn't seem to be detailed enough" on who decides forgiveness and how much is reduced.

The city attorney told the commission the draft ordinance lists 15 standards that must be considered and includes directions on applying those standards, calling the draft "quite well written" compared with the prior, largely discretionary practice. The ordinance will return for a second reading before it becomes effective.

The commission approved the first‑reading motion by voice vote (recorded in the meeting as unanimous).
