Garden Ridge commission conducts line‑by‑line redline of draft wastewater ordinance, flags numbering and definition gaps

The Garden Ridge Water Commission spent the bulk of its June 16 meeting on a detailed redline review of a revised wastewater ordinance, identifying multiple editorial and substantive clarifications staff should make before the commission forwards a recommendation to city council.

Commissioners and staff repeatedly urged explicitly referencing state on‑site septic standards (transcript reference to "30 admin code 285"). One participant suggested adding a definition that points readers to the applicable state rule for septic systems so the ordinance does not create unintended gaps: "If it isn't referenced someplace it could cause problems later down the line," a commissioner said during discussion.

The commission also flagged a series of indexing and typographical errors introduced when definitions were moved into a separate section (several section references appear off by one). Commissioners pointed out word‑choice typos (for example, a passage that reads "slugs" appears to intend "sludge") and recommended that staff supply a redline showing corrections.

Members raised definitional and enforcement questions, including whether the broad definition of "industrial waste" could unintentionally capture small food‑processing activities, how the ordinance should treat household waste grinders, and how the approving authority will be defined and exercise inspection authority. Several commissioners noted that portions of the draft were adapted from another jurisdiction's ordinance and urged care not to remove clarifying references when portions are lifted from that source.

Staff said some of the issues are typos and can be corrected quickly and that other items may warrant follow‑up with the interlocal partner whose standards were adapted. The commission asked staff to finalize a corrected redline and return the draft for a final review in July.

The commission did not adopt the ordinance at the meeting; staff and the chair agreed to consult with the city attorney on whether a public hearing at the commission level is required and on the applicable notice requirements for such a hearing.
